CCTV Policy

1. Introduction

This policy explains how the Ommaroo Hotel Limited (“we”, “us”, “our”) uses Closed Circuit Television (CCTV) systems and how we process personal data captured by those systems.

This policy should be read alongside our Privacy Policy.

For the purposes of the Data Protection (Jersey) Law 2018, the Ommaroo Hotel Limited is the data controller.

2. Purpose of CCTV

We use CCTV systems to support the safety and security of our guests, staff and property.

CCTV is used for the following purposes:
•    maintaining the safety and security of guests, staff and visitors
•    preventing and detecting crime and anti-social behaviour
•    assisting law enforcement where required
•    investigating incidents, accidents and complaints
•    supporting insurance and legal claims.

We have carried out a data protection impact assessment and consider the use of CCTV to be necessary and proportionate for these purposes.

3. Legal Basis for Processing

We process CCTV data under the lawful basis of legitimate interests, namely, to ensure the safety, security and effective management of our hotel.

Where required, processing may also be necessary for compliance with legal obligations.

4. Location of Cameras

CCTV cameras are located in key areas of the Hotel, including:

•    entrances and exits
•    reception areas
•    bar and public areas
•    external areas and access points.

Cameras are positioned to minimise intrusion into private areas. 

CCTV is not used in areas where individuals would reasonably expect privacy (such as bedrooms or bathrooms).

Clear signage is displayed throughout the premises.

5. Audio Recording (Conditional Use)

CCTV systems may include audio recording functionality; however, audio recording is not continuous and is only activated in limited, specific circumstances where it is necessary and proportionate.

This may include situations such as:

•    investigating a specific incident or complaint
•    where there is a heightened risk to safety or security
•    where required to support a law enforcement request.

Audio recording is:

•    used only for clearly defined purposes
•    strictly controlled and access-restricted
•    reviewed only where necessary for investigation.

Where audio recording is used, it is applied in a targeted and proportionate manner.

6. Recording and Retention

CCTV footage is recorded continuously.

•    Standard retention period: up to 30 days
•    Incident footage: retained for up to 6 years where an incident has been reported and footage recorded as required for legal, insurance or law enforcement purposes.
•    Footage is securely stored and automatically deleted when no longer required.

7. Access and Disclosure

Access to CCTV footage is restricted to authorised personnel only.

Footage may be disclosed where appropriate:

•    to law enforcement authorities
•    in response to a legal obligation or court order
•    to investigate incidents or complaints
•    to insurers or legal advisers.

All access and disclosures are logged and documented.

8. Data Security

We take appropriate technical and organisational measures to protect CCTV data, including:

•    restricted access controls
•    secure storage systems
•    controlled viewing procedures.

9. Your Rights

Under the Data Protection (Jersey) Law 2018, you have the right to:

•    request access to your personal data (including CCTV images where identifiable)
•    request correction or deletion where applicable
•    object to processing in certain circumstances
•    request restriction of processing.

10. Making a Request

If you wish to request CCTV footage, please provide:

•    date and time of the incident
•    location within the Hotel
•    sufficient detail to identify yourself
•    proof of identity.
